The Justice Department on Friday refused to issue a signed declaration from acting Attorney General Todd Blanche verifying that it no longer intends to pursue President Donald Trump's "Anti-Weaponization Fund."

The DOJ's refusal comes after a federal judge last week gave the administration seven days to verify in a declaration that it wouldn't create the controversial fund.

"Such declarations are unnecessary and the compelled testimony of senior officials from the Executive Branch implicates serious separation of powers concerns," the DOJ said in a court filing Friday to U.S. District Judge Leonie Brinkema, who last week issued an injunction indefinitely blocking the administration from creating the fund.

Brinkema had given the Trump administration seven days to verify in a declaration from acting Attorney General Todd Blanche and Treasury Secretary Scott Bessent that it wouldn't create the fund, which she said would likely lead to the dismissal of the lawsuit she was overseeing against the fund.

But in their filing Friday, the department argued that Brinkema's offer was a potentially unconstitutional infringement of the executive branch by effectively requiring "testimony" of top officials on a matter that the administration has repeatedly said would not be moving forward.

This fund is being adopted by means of a "fraud on the Court" in a lawsuit that was null and void due to a lack of case or controversy. trump really wants this fund and this issue will need to be litigated.

trump really wants this slush fund and so the DOJ will NOT acknowledge in writing that this fund is dead. There is litigation pending before a Florida Court and the Virginia court. The issue of whether this was a "fraud on the court" and whether there was a real lawsuit in the first place due to a lack of a "case or controversy" will be litigated.

President Donald Trump's Department of Justice thrashed a federal judge in a new court filing for demanding that DOJ officials and two Trump cabinet secretaries officially declare that Trump's "anti-weaponization" slush fund is officially dead.

Last month, the Trump administration announced plans to create a $1.776 billion fund to pay claims from people who allege they were wrongfully prosecuted by the federal government. Several of Trump's allies, including formerly convicted members of the Proud Boys, declared that they would seek restitution from the fund, which sparked significant bipartisan pushback.

Political analysts and experts have described the fund as a "slush fund" because the Trump DOJ would have full control over who is eligible for payments, and the legal paperwork establishing the fund states that the federal government bears no responsibility if crimes are committed by people who receive payments.

Acting Attorney General Todd Blanche told the House and Senate judiciary committees that the administration is no longer pursuing the fund, but has refused to put that in writing.

On Friday, the Trump DOJ told a judge in the Eastern District of Virginia that it won't abide by a demand to declare the fund dead. The DOJ argued in the filing that multiple Trump administration officials have said the fund is not moving forward, and those past statements should satisfy the court's demand. It also attached a copy of Blanche's testimony to Congress as evidence of its claims.

The Trump administration refused to formally kill its nearly $1.8 billion “anti-weaponization” fund on Friday, declining to submit a court-requested sworn declaration to a federal judge acknowledging the program is dead.

Instead, the Department of Justice continued to rely on Acting Attorney General Todd Blanche’s congressional testimony that the administration is not moving forward with the fund.

In a notice to the court, the DOJ wrote, “Such declarations are unnecessary and the compelled testimony of senior officials from the Executive Branch implicates serious separation of powers concerns.”

The refusal by Blanche and the DOJ to put a pledge in writing not to create the fund — aimed at compensating those who believe they were the victims of alleged prosecutorial overreach —is likely to spark political backlash, especially on Capitol Hill where Blanche’s permanent nomination to head the department is pending.

The DOJ maintains its public statements — both in Blanche’s congressional testimony and in written court filings and hearings — should be sufficient. “All these statements were made under the backdrop of serious penalties for falsity,” it writes. “So there is no reason why declarations should affect the Court’s mootness analysis.”,,,,,

At last week’s hearing in Virginia, Brinkema expressed similar misgivings about Trump’s comments and Blanche’s reluctance to put a pledge not to create the fund in writing. These misgivings will likely continue to bubble now that the DOJ has declined to submit the declaration and the litigation will likely continue.

There are at least two separate federal court cases. In addition to the Virginia case described above, there is a separate lawsuit brought by 35 retired federal judges seeking to litigate (i) whether this slush fund was a "fraud on the court" and (ii) whether there was a valid lawsuit in the first place because there was no case or controversy. trump's attorneys refused to answer the courts issues in that case. This will be fun to watch
