AI is a tool that requires a person to take the information AI produce and to implement it. Whomever approved the strike based on the AI recommendation is the one who should be prosecuted.
In addition, those in the military chain-of-command should be prosecuted if they knew they were attacking a school and did nothing to stop the attack.

A human person authorized the strike, either directly or indirectly.
Determine who that person is.
