Speaker Mike Johnson floats eliminating federal courts as GOP ramps up attacks on judges

WASHINGTON Facing pressure from his right flank to take on judges who have ruled against President Donald Trump, Speaker Mike Johnson, R-La., on Tuesday floated the possibility of Congress eliminating federal courts.
Its the latest attack from Republicans on the federal judiciary, as courts have blocked a series of actions taken by the Trump administration. In addition to funding threats, Trump and his conservative allies have called for the impeachment of certain district court judges who have ruled against him, most notably U.S. District Judge James Boasberg, who attempted to halt Trump from using the Alien Enemies Act to deport Venezuelan migrants.
We do have the authority over the federal courts, as you know. We can eliminate an entire district court. We have power of funding over the courts and all these other things, Johnson told reporters on Tuesday. But desperate times call for desperate measures, and Congress is going to act.
Johnson, a former constitutional attorney, later clarified that he was making a point about Congress broad authority over the creation, maintenance and the governance of the courts. Article III of the Constitution established the Supreme Court but gave Congress the power to ordain and establish lower federal courts..

(851 posts)every single Dem should understand that Job #1 is not about "reaching across the aisle" to compromise on some legislation. 90% of the job should be outside -- at rallies, at town halls, on talk shows, on podcasts, on social media.
When opportunities present themselves to use what remains of the Congressional structure, such as yesterday's hearings about the classified security break, we should do that. But that will be the exception to the rule.
Get outside. There isn't much for us inside the Capitol

These people (GOP-ers_ really are living in a different universe. This morning there was a thread posted with a graphic of headlines of different right wing sources. I can't find it now, but their headlines mention nothing about the important news of the day, namely the Signal group meeting.

Two key words open for reinterpretation - "inferior" plus "and"
Just like their reinterpretation of the 14th Amendment to not only allow tramp on a ballot, but give him immunity, those two words might be a problem.
First off, what is the constitutional definition of Inferior courts?
Secondly, does the comma preclude the Congress from dissolving the SCOTUS also? Reading the statement as Congress may ordain and establish (also remove?), it may read that interpretation could include removing the SCOTUS!
Don't believe it? Remember the 14th and the problems that caused.
I could interpret that as allowing the Congress to do what it will with "inferior courts" AND the SCOTUS -
"Invested in one Supreme Court AND in such inferior courts as the Congress may...
I'm sure they can't, But I was also sure tramp couldn't be on the ballot and the current pres doesn't have immunity from whatever.
Pretty sure how Roberts et al will rule on that one. Ok for we, but them ain't us.

(777 posts)Right now it's a question of practicalities what they're capable of. Which is why we need to dare them to act on all threats they make, and not let them get away with any level of intimidation. We need a baseline of fact.
It's infuriating how few with any sort of authority understand that. Nearly all seem to be doing the exact opposite, allowing the occupation to create a maximum cloud of fear and confusion.

So, whats a partisan congressional leader to do? The answer, evidently, is to consider some radical alternatives to impeachment. Punchbowl News Jake Sherman, an MSNBC contributor, spoke with House Speaker Mike Johnson, and the Louisiana Republican shared one possible approach:
We do have authority over the federal courts. As you know, we can, we can eliminate an entire district court. ... We have power, funding over the courts and all these other things. But desperate times call for desperate measures and Congress is going to act so stay tuned for that.
Sherman noted soon after that the House speaker clarified that he didnt mean this as a direct threat. Im trying to illustrate we have a broad scope of authority over the courts, Johnson added.
And as part of this broad scope of congressional authority over the courts, whats on the table? Quite a bit, actually. Over the course of the last week or so, Republican lawmakers have opened the door to a series of possible alternatives to judicial impeachments. GOP officials are considering:
Legislation to bar district court judges from issuing nationwide injunctions.
Blocking funding for district courts that issued rulings that Trump doesnt like.
Holding House and Senate hearings to focus attention on judges whove issued rulings that Trump doesnt like.
It was against this backdrop that the House speaker brought up his belief that Congress could eliminate an entire district court.
