Judge dismisses lawsuit over Downers Grove sperm bank mistake
A DuPage County judge Thursday dismissed a lawsuit filed by an Ohio woman seeking damages against a Downers Grove sperm bank that shipped her the wrong sample and resulted in the birth of her biracial daughter.
Jennifer Cramblett's lawsuit was dismissed with prejudice by Judge Ronald Sutter, which ends the suit in state court. However, Cramblett's attorneys filed a suit in federal court in Chicago in April, so she will continue to seek damages there.
In March, the judge had dismissed portions of Cramblett's suit but had set an April 25 deadline for her to refile. She has not filed any additional pleadings in DuPage since, and the judge granted a motion for dismissal Thursday that had been filed by the sperm bank's legal team.
The Canton-area resident ordered sperm from the bank in 2011. But the bank, in an order error, sent a different sample that had been contributed by an African-American.
