Attorney suing over Wayne County bus tax will ask judge to bar question from ballot
Livonia The lawyer leading a group of Wayne County residents who claim ballot language for the county's transit millage was illegally approved says they will ask a circuit court judge to stop the measure from appearing on this August's ballot with its current wording.
The group of six Wayne County residents, led by attorney Matthew Wilk filed a lawsuit last Friday claiming the county's Transit Authority and Board of Canvassers approved ballot language for a proposed 10-year, $570 million tax to subsidize SMART bus service during an illegal secret meeting on March 19.
"They have to play by the rules," said attorney Matthew Wilk, who is a plaintiff in the lawsuit and held a press conference on Wednesday at Marriott on North Laurel Park Drive. "If they comply with the obligations, they're entitled to put it on the ballot, and voters are entitled to have their say on whether this is approved or not,"
Wilk said he plans to file a motion asking a circuit judge for a preliminary injunction once the county has been served with the lawsuit. An injunction temporarily stops an action from being taken by a party it is being enforced against while the legal case works its way through the court system.
