They indicted on a 2023 action for a law passed in 2024?
From the information in the article, it seems like an attempt at retroactive prosecution.
Also, something seems fishy about the story. "The boyfriend" bought the pills, he "made her" take them, and she "couldn't regurgitate" them.
That all seems an incredibly convenient set of circumstances.
