I don't see any scenario we get 67 senators willing to consider this. If we get to 50 willing senators and a willing president, we can have hearings, and do a judiciary reboot via expansion and new legislation to get that court to rule in line with Warren/Burger/early Rehnquist decisions.

A failed impeachment trial probably takes the wind out of the sails
