That weakens the argument that it is protected by the speech and debate clause. However, he was calling for Congressional investigations, subpoenas, etc., which brings it closer to the purpose of the Speech and Debate Clause.

In any event, Musk couldn't win a defamation case because he wouldn't be able to prove actual malice.
