The 70-day speedy trial clock typically starts after the arraignment and the arraignment in this case took place on May 15. But under the Act the 70 day period is tolled by the filing of a motion to dismiss. Dugan filed a motion to dismiss the indictment on May 14, but didn't file a memorandum in support of that motion until May 29.

The July 21 date, arguably, was well within the speedy trial act requirements -- which is probably why Dugan's counsel didn't object to the original schedule, under which the government's reply to the motion to dismiss was due June 9 and Dugan was given until June 16 to reply. Nor did Dugan's counsel push for prompt action on the motion to dismiss, which was pending before a magistrate judge, not the judge assigned the case for trial.

And I'm unaware of there being such a thing as a "reconciliation tribunal' in the US.
