'Correct the record': Judge Cannon 'made a number of errors' and 'inappropriate' accusations while burying Jack Smith's report, appeals court told

Senate Judiciary Committee Democrats on Thursday expressed an urgent need to "correct the record," hoping a federal appeals court will overrule U.S. District Judge Aileen Cannon and make Jack Smith's report on the Mar-a-Lago classified documents prosecution of President Donald Trump public.

The amici curiae — or "friends of the court" — represented by former Obama administration ethics czar Norm Eisen's group Democracy Defenders Action, submitted a brief for the 11th U.S. Circuit Court of Appeals to "consider in rendering its ruling" after hearing oral arguments in the coming months.


The Trump-appointed jurist dismissed the case against the then-presidential candidate in July 2024, finding after "careful study" that Smith was unlawfully appointed as special counsel.

Then, on Jan. 21, 2025, one day after Trump's inauguration, she first issued an injunction keeping the report from Congress, citing the then-pending appeals of Trump's former co-defendants, valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira.

Sens. Adam Schiff, Richard Blumenthal, Sheldon Whitehouse, Cory Booker, Chris Coons, Peter Welch, Dick Durbin, Mazie Hirono, Alex Padilla and Amy Klobuchar told the 11th Circuit that Cannon's "wrong" order — premised in part on the idea that congressional requests for Volume II were not "official" — also ignored the "lack of adversity" between Trump the former co-defendant and Trump as the head of the executive branch in the existing dispute.
